1031 QualEx

Consumer Protection

Your money, protected.

During an exchange, your intermediary holds your sale proceeds, often the largest balance you'll ever entrust to anyone. Here is exactly how those funds are protected at 1031 QualEx.

  • Segregated accounts, never commingled

Every client's exchange funds are held in their own segregated account, separate from our operating funds and from every other client's money. Your funds are disbursed only for your replacement purchase or returned to you at the end of the exchange period.

  • Attorney-run, with no other corporate ties

1031 QualEx is operated by an attorney in good standing with the Arkansas Bar and is an independent company with no competing corporate ties. The person responsible for your funds is licensed, accountable, and reachable by phone.

  • Underwritten and insured by Lloyd's

We carry coverage underwritten by Lloyd's of London, the official insurance program of the Federation of Exchange Accommodators.

  • FEA membership and industry standards

We are members of the Federation of Exchange Accommodators, the only national trade organization for the 1031 exchange industry, and operate under its code of ethics.

Software-enforced compliance

Our Exchange Manager software tracks every rule and deadline on every exchange, keeps the accounting, and sends automatic notices, so compliance never depends on someone remembering.

Questions to ask any Qualified Intermediary

The exchange industry is lightly regulated at the federal level, which makes voluntary standards, insurance, and transparency the real measures of an intermediary. Ask any QI you’re considering these questions; we’re glad to answer all of them.

  • Are my funds held in a segregated account in my name?
  • Who owns the company, and what else do they do?
  • What insurance do you carry, and through whom?
  • Are you a member of the FEA?
  • Who is responsible for my exchange, and can I reach them directly?

Talk through your exchange before you close.

A ten-minute call is usually enough to know whether a 1031 exchange fits your sale. No cost, no obligation.
